Minutes of Regular Session

The Mayor and Board of Aldermen met in regular session on Monday, December 13, 2010 at 6:00 p.m. in the City Hall with the following members present:

Alderman Eddie Barnett, Jr.         Alderman Paul Barkley

 

City Clerk Randall Baker was present and performed the duties of his office.

 

The mayor called the session to order and requested a roll call.

 

Public Hearing on Polsgrove Annexation

A public hearing was conducted at this time to give any interested person, corporation or political subdivision the opportunity to offer comments both oral and written regarding the proposed annexation of property at 35134 County Road 229 owned by Floyd and Peggy Polsgrove and more fully described as:

 

A part of the SW ¼ SE ¼ of Section 34, Township 22 North, Range 9 East, Dunklin County, Missouri, containing 1.37 acres being subject to rights of way and being further described as follows:  Starting at the NW Corner of the SW ¼ SE ¼ of Section 34, Township 22 North, Range 9 East, thence South 0 degrees 14 minutes West 490.4 feet to the point of beginning; thence continue South 0 degrees 14 minutes West along ¼ Section line 181.5 feet; thence North 89 degrees 38 minutes East 321.7 feet; thence North 0 degrees 14 minutes East 190.5 feet; thence South 87 degrees 58 minutes West 321.82 feet to the point of beginning.

 

The Mayor asked if there were any comments on the proposed annexation.  There were no oral comments other than Chief of Police Weldon Wallace stated he thought it was a good idea to annex the property.  The Mayor then asked if there had been any written comments received.  The City Clerk reported there had been no written comments received.

 

The public hearing was then adjourned.

 

Approval of minutes

Motion was made by Alderman Barnett and seconded by Alderman Barkley to approve the minutes of the November 8, 2010 regular session.  Motion carried unanimously.

 

Motion was made by Alderman Barkley and seconded by Alderman Allen to approve the minutes of the November 8, 2010 closed session.  Motion carried unanimously.

 

Payment of bills

Motion was made by Alderman Barnett and seconded by Alderman Barkley to allow payment of the monthly bills.  Motion carried unanimously.

 

Sidewalks at Civic Center

An engineering report concerning the sidewalks on the south side of Grand Avenue and the east side of South Locust Street was reviewed by the Council.  The report states that the sidewalk replacement concrete is already experiencing multiple hairline cracks along the surface.  The reasons can most likely be attributed to an excessively high water-to-cement ratio and placement at or below freezing temperatures.  These factors have combined to create a concrete mass with insufficient strength and durability requirements.  The hairline cracking will most likely continue to become worse until the entire surface spalls. Intrusion of water into these cracks with subsequent freeze-thaw cycles will hasten this deterioration.

 

The engineer’s recommendation is that the sidewalk replacement should itself be replaced.  Otherwise, he would recommend requiring the contractor to put up a bond with the City for an agreed upon time to cover the cost of replacement should the expected failures occur during said specified timeframe.

 

The City Attorney was contacted by telephone during the discussion of the sidewalks and advised that he and a representative of the City Council should meet with the contract who poured the sidewalks and discuss a solution to the problem.  While the Mayor and the Aldermen agree that the contractor does good work, this is a situation in which a mistake was apparently made on the construction of the sidewalks and the contractor needs to correct the mistake.  Motion was made by Alderman Barnett and seconded by Alderman Barkley directing the City Attorney to contact the contractor by letter to work out a solution to the problem with the sidewalks.  Motion carried unanimously.

 

Visitor’s Center engineering report

Another engineering report concerning the Visitor Center was reviewed.  The report states that the structure shows multiple signs of aggressive deterioration, almost exclusively from water infiltration.  The sill and first course of logs have extensive rot around the entire perimeter with the most advanced deterioration occurring along the front of the building, most specifically to the right of the doorway at a point adjacent to where rain water from the roof valley splashes onto the perimeter concrete side walk.  The concrete of the side walk at that spot is showing signs of surface erosion normally associated with free falling water.

 

The porch columns are showing signs of deterioration at their bearing on the concrete.  This deterioration is manifested in a mushrooming effect of the column tip.  As water is absorbed into the end of the column, the fibers swell and begin splitting along grain boundaries.  The wetted fibers then begin to rot, reducing the effective bearing area of the column and eventually resulting in the previously mentioned mushrooming.

 

The majority of the original logs of the wall structure appear to be in a serviceable condition with few splits or checks.  The replacement logs, however, are showing considerable checks and splits.  The most likely culprit would be that these logs were not thoroughly dried prior to installation, in other words installed while still green.  The outside face dried more rapidly than the inside due to exposure to sun, wind, etc.  This rapid differential drying would produce the extensive checks and splits that exist in these logs.  A secondary effect of the checks and splits, and also of the breakdown of the waterproofing varnish, has been accelerated deterioration of some of the wall logs beyond the sill and first course.  While not as severe as the sill and first course, several localized areas are in need of repair in a timely fashion if those logs are to be saved.

 

The engineer recommends that repair of the sill and first course of logs should be the first priority.  After all wood repairs are complete; all non-painted wood surfaces should be coated with a waterproof sealer rated for outdoor use.  The porch columns should be replaced and a galvanized column standoff base should be utilized.

 

While the building does not belong to the City of Campbell the building is an asset to the community and a landmark and the Council agreed to help in any way possible to save the building.

 

The Mayor was asked to contract the Historic Development Organization that owns to building to discuss their plans to repair the building.

 

Salary and pay increase for December 2008

Motion was made by Alderman Allen and seconded by Alderman Grubbs that the city employees be given an increase in pay during the month of December, 2010 in the amount of $100.00 for full time employees, $25.00 for part-time employees, reserve officers and volunteer firemen plus the amount of the FICA and Medicare taxes on those amounts.  Motion carried unanimously.

 

Annexation request

Motion was made by Alderman Grubbs and seconded by Alderman Allen to accept the petition of Goodnight-Williams Investments and Rocky D. and Laveda Whiteside to annex certain real estate described as;

 

A part of the Northwest Quarter of the Southwest Quarter and a part of the Southwest Quarter of the Southwest Quarter of Section 34, Township 22 North, Range 9 East of the Fifth Principal Meridian, Dunklin County, Missouri and being further described as follows: Beginning at a point that lies South 290.65 feet and East 292.81 feet from the Northwest corner of the said Northwest Quarter Southwest Quarter and run thence East 1025.59 feet; thence South 00 degrees 25’ 51” West 1502.19 feet; thence North 89 degrees 23’ 30” West 300.00 feet; thence South 00 degrees 36’ 30” West 139.99 feet, more or less, to the North right of way line of Missouri State Highway No. 153; thence North 50 degrees 01’ 01” West 930.30 feet along said right of way line; thence North 1040.96 feet to the point of beginning and containing 32.52 acres, more or less.  Subject to rights of ways and easements of record, if any.

A part of the Northwest Quarter of the Southwest Quarter and a part of the Southwest Quarter of the Southwest Quarter of Section 34, Township 22 North, Range 9 East of the Fifth Principal Meridian, Dunklin County, Missouri and being further described as follows: Beginning at a point that lies South 290.65 feet from the Northwest corner of the said Northwest Quarter Southwest Quarter and run thence East 292.81 feet; thence South 1040.96 feet to the North right of way line of Missouri State Highway No. 153; thence North 50 degrees 01’ 01” West 137.32 feet along said right of way line; thence North 39 degrees 58’ 59” East 10.00 feet along said right of way line; thence North 50 degrees 01’ 01” West 100.00 feet along said right of way line; thence North 39 degrees 58’ 59” East 30.00 feet along said right of way line; thence North 50 degrees 01’ 01” West 179.47 feet along said right of way line; thence North 743.20 feet to the point of beginning and containing 6.00 acres, more or less.  Subject to road right of way and easements of record, if any.

 

and proceed to annex.  Motion carried unanimously.

 

City Treasurer salary increase

Motion was made by Alderman Allen and seconded by Alderman Barnett to increase the monthly salary for the City Treasurer to $200.00.  Motion carried unanimously.

 

Annual fiscal year audit accepted

Motion was made by Alderman Grubbs and seconded by Alderman Barkley to accept the annual audit for the 2009-2010 fiscal year as prepared and presented by certified public accountants Metheny and Smith of Kennett, Missouri.  Motion carried unanimously.

 

Closed Session

Motion was made by Alderman Allen and seconded by Alderman Barnett to go into closed session to discuss matters as allowed under section 610.021, RSMo and those matters only.  A roll call vote was taken with Alderman Barnett voting yes, Alderman Barkley voting yes, Alderman Grubbs voting yes and Alderman Allen voting yes.

 

After returning to open session the minutes reflect personnel matters were discussed.

 

City Clerk accumulated overtime and sick leave approved

Motion was made by Alderman Barnett and seconded by Alderman Grubbs to approve payment of accumulated overtime and sick leave for City Clerk Randall Baker.  Motion carried unanimously.

 

Eric Weeks on Volunteer Fire Department

Motion was made by Alderman Grubbs and seconded by Alderman Allen approving the Mayor’s appointment of Eric Weeks to the volunteer fire department.  Motion carried unanimously.

 

Adjournment

Motion was made by Alderman Barnett and seconded by Alderman Barkley to adjourn.  Motion carried unanimously.
