Monday,
November 8, 2010
The Mayor
and Board of Aldermen met in regular session on Monday, November 8, 2010 at 6:00
p.m. in the City Hall with the following members present:
Mayor
Raymond Gunter
Alderman
William Allen
Alderman Eddie Barnett, Jr.
Alderman
Paul Barkley
Alderman
Gary Grubbs was absent.
City Clerk
Randall Baker was present and performed the duties of his office.
City
Attorney Mike Mowrer was present as legal counsel for the City.
The mayor
called the session to order and requested a roll call.
Public
Hearing on Polsgrove Annexation
A public
hearing was conducted at this time to give any interested person, corporation or
political subdivision the opportunity to offer comments both oral and written
regarding the proposed annexation of property at 35134 County Road 229 owned by
Floyd and Peggy Polsgrove and more fully described as:
A part of
the SW ¼ SE ¼ of Section 34, Township 22 North, Range 9 East, Dunklin County,
Missouri, containing 1.37 acres being subject to rights of way and being further
described as follows: Starting at
the NW Corner of the SW ¼ SE ¼ of Section 34, Township 22 North, Range 9 East,
thence South 0 degrees 14 minutes West 490.4 feet to the point of beginning;
thence continue South 0 degrees 14 minutes West along ¼ Section line 181.5 feet;
thence North 89 degrees 38 minutes East 321.7 feet; thence North 0 degrees 14
minutes East 190.5 feet; thence South 87 degrees 58 minutes West 321.82 feet to
the point of beginning.
The Mayor
asked if there were any comments on the proposed annexation.
There were no oral comments.
The Mayor then asked if there had been any written comments received.
The City Clerk reported there had been no written comments received.
The public
hearing was then adjourned.
Approval
of minutes
Motion was
made by Alderman Barnett and seconded by Alderman Barkley to approve the minutes
of the October 12, 2010 regular session.
Motion carried unanimously.
Motion was
made by Alderman Barkley and seconded by Alderman Allen to approve the minutes
of the October 12, 2010 closed session.
Motion carried unanimously.
Payment of
bills
Motion was
made by Alderman Allen and seconded by Alderman Barnett to allow payment of the
monthly bills. Motion carried
unanimously.
Judge
Godley Concerning Minimum Fine Ordinance
Municipal
Judge Barbara Godley spoke to the Council at this time about Ordinance 689
passed at the October meeting concerning the minimum amount of any fine assessed
in cases filed in the municipal court.
Judge Godley explained why she felt the passage of the Ordinance was not
a wise move and asked the Council to rescind the action and repeal the
Ordinance.
The
Council explained that the passage of the Ordinance was done in order to deter
Ordinance violations and was in no way intended to reflect on the Municipal
Court or the Municipal Judge.
Sell
Property to Richard Hall
The
following bill was then introduced and read.

ORDINANCE NO. 690
AN
ORDINANCE OF THE CITY OF CAMPBELL, MISSOURI AUTHORIZING THE SALE
OF CERTAIN REAL ESTATE
OWNED BY THE CITY OF CAMPBELL TO RICHARD A. HALL AND ELIZABETH A. HALL
FOR THE SUM OF $1,000.00.

WHEREAS,
the Board of Aldermen of the City of Campbell, Missouri have found and
determined that in order to provide for the good and proper operation of said
City an Ordinance authorizing the
sale of certain real estate owned by the City of Campbell should
be and is by this Ordinance adopted and placed into effect.
1.
The City of Campbell owns the following described real
estate:
Beginning
at the Southwest Corner of Lot Four (4) in Block Eight (8) in the Forrest Hill
Addition to the City of Campbell, Dunklin County, Missouri; running thence East
155 feet to the Southeast corner of said Lot Four (4); thence North along the
East boundary line of said Lot Four (4) a distance of 60 feet; thence West
parallel with the South boundary line of said lot 155 feet; thence South 60 feet
to the place of beginning.
2.
It is in the public’s interest that the City of
Campbell
sell the property.
IT IS NOW ORDAINED BY THE BOARD OF ALDERMEN OF THE CITY OF CAMPBELL, MISSOURI,
TO-WIT:
Section 1.
The Mayor and Clerk are authorized and directed to execute any and all
documents necessary, including the Warranty Deed, to complete the sale of the
above described real estate to Richard A. Hall and Elizabeth A. Hall for the sum
of $1,000.00.
Section 2.
Conflicting Ordinances Repealed.
All Ordinances or parts of Ordinances in conflict herewith are repealed.
Section 3.
This Ordinance shall be in full force and effect upon its passage,
approval and adoption.
Read the first time, passed and approved this 8th day of November,
2010.
Read the second time, passed and approved this 8th day of November,
2010.

Motion was
made by Alderman Barkley and seconded by Alderman Allen that the bill be placed
upon a second reading. Motion
carried unanimously.
Motion was
made by Alderman Allen and seconded by Alderman Barkley that the bill pass and
become Ordinance number 690. Motion
carried unanimously.
Closed
Session
Motion was
made by Alderman Allen and seconded by Alderman Barnett to go into closed
session to discuss matters as allowed under section 610.021, RSMo and those
matters only. A roll call vote was
taken with Alderman Barnett voting yes, Alderman Barkley voting yes, and Allen
voting yes.
After
returning to open session the minutes reflect personnel matters were discussed.
Amy Preyer
Appointed Prosecutor
As
Municipal Prosecutor Mark Preyer has been elected as the new Division III
Associate Circuit Judge he will be required to resign as the Municipal
Prosecutor. Mayor Gunter stated
that he would like to appoint Amy M. Preyer as the Municipal Prosecutor to fill
the vacancy which will be created by Mr. Preyer’s resignation.
Motion was
made by Alderman Barnett and seconded by Alderman Barkley to approve the Mayor’s
appointment of Amy M. Preyer as the City’s Prosecutor effective upon the
resignation of Mr. Mark Preyer.
Motion carried unanimously.
City
Attorney and City Prosecutor Salary Increase
An
increase in pay for the positions of City Attorney and City Prosecutor was
discussed. The salaries had not
been increased since 1997. Upon the
review and discussion of the salaries for the City Attorney and the City
Prosecutor motion was made by Alderman Barkley and seconded by Alderman Barnett
to increase each of the monthly salaries for the City Attorney and the City
Prosecutor to $750.00 per month effective December 1, 2010.
Motion carried unanimously.
Goodnight/Williams Annexation
Shaun
Goodnight and Danny Williams met with the Council to discuss annexation of
property they own contiguous with the city limits.
The City Attorney advised that he would need to meet with the owners to
review their deeds and surveys before proceeding.
Election
Filing Dates
Motion was
made by Alderman Barnett and seconded by Alderman Allen that the opening date
for candidate filing for the April 5, 2011 election be set as 8:00 a.m. on
Tuesday, December 14, 2010 and that the closing date for same be set as 5:00
p.m. on Tuesday, January 18, 2011 and that the City Clerk publish notice of the
filing dates and the offices open for election.
Motion carried unanimously.
Fitness
Center Memberships For Employees
As a
health incentive for the city employees, motion was made by Alderman Barnett and
seconded by Alderman Barkley that the City pay an annual fee of $250.00 per
month for full-time city employees memberships to the CDDC Fitness Center.
Motion carried unanimously.
Salary and
pay increase for November 2010
Motion was
made by Alderman Barnett and seconded by Alderman Barkley that the city
employees be given an increase in pay during the month of November, 2010 in the
amount of $25.00 plus the amount of the FICA and Medicare taxes on those
amounts. Motion carried
unanimously.
Danny
Ogden Appointed To Housing Authority Board
The Mayor
reported that Gary Grubbs had decided not to accept the appointment to the
Campbell Housing Authority Board of Directors.
The Mayor then asked for approval of his appointment of Mr. Danny Ogden
to that Board.
Motion was
made by Alderman Barkley and seconded by Alderman Barnett to approve the Mayor’s
appointment of Danny Ogden to the
Campbell Housing Authority Board of Directors for a term of four years
retroactive to August 23, 2010.
Motion carried unanimously.

Motion was
made by Alderman Barnett and seconded by Alderman Barkley to adjourn.
